1. CALL SPECIAL MEETING TO ORDER – MAYOR
Mayor Klosowski called the Special Meeting to order at 6:30 p.m.

MOTION: By Mayor Pro Tem Grassi, seconded by Councilmember Belleci, to excuse the absence of Councilmember Figueroa.
The motion carried.
Staff Present: Interim City Manager Sugg, Assistant City Manager Craig, Finance Director Layden, City Attorney Victor, Development Services Director Swindale, Assistant Development Services Director King, Interim Building Official Bentley, and Deputy City Clerk Nicholas.
COUNCIL CONSIDERATION
3. MARKET COURT SEWER CONTRACT BID AWARD
Staff Report – Interim City Manager Sugg described the scope of work included in the project bid that is necessary to meet requirements of the permit conditions. The Market Court West Sanitary Sewer Improvements Project will provide construction of 140 lineal feet of sanitary sewer and minor asphalt concrete pavement in Market Court West from Market Place to Drexler Drive.
Public Comment – None.
Council Consideration - MOTION: By Mayor Pro Tem Grassi, seconded by Councilmember Belleci, to authorize the City Manager to award the Market Court West Sanitary Sewer Improvements Project to RS Underground, Inc. in the amount of $29,855.86 and execute all necessary contract documents.
The motion carried.
RECESS TO STUDY SESSION – At 6:38 p.m., Mayor Klosowski recessed to Study Session.
4. DEVELOPMENT SERVICES FEES AND CHARGES – Development Services Director Swindale reported the EDC stakeholder group findings relating to the Development Services Fees and Charges review. Following an increase in certain City fees and a State Auditor released performance audit of county building permit and inspection fees, Council placed a sunset date on those new fee levels and
directed staff to work with the Economic Development Commission and others to conduct a stakeholder review.
In response to Mr. Swindale’s staff report, Council directed staff to bring forward a recommendation regarding the sunset date for Development Services Fees and Charges at the June 21, 2010 Council Meeting.
5. BUILDING/ZONING CODE AMENDMENTS – Development Services Director Swindale provided background on the proposed Fire Code and Building Code Amendments, and R1 and R2 zone retaining walls. The State Building Code Council advises the State Legislature on updates to the State Building Code which occur on a three year cycle. The City adopts the State Building Code with amendments recommended by the Building Official and Fire Marshal. Staff recommended that the City maintain the existing energy code due to a request by Governor Gregoire to stimulate economic development.
Fire Marshal Dupille informed Council that he will bring forth a proposed amendment to the Fire Code that would require all new single family homes to have fire suppression installed. This is currently included in the International Codes; however, the State has chosen to make it an elective requirement.
6. EXECUTIVE SESSION
At 8:34 p.m., Mayor Klosowski adjourned to Executive Session for approximately one hour, per RCW 42.30.110 to discuss potential litigation with legal counsel.
7. ADJOURNMENT
The meeting adjourned at 9:00 p.m. No other action followed.
