ORDINANCE NO. 620

 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, GRANTING A TWO-YEAR EXTENSION OF ORDINANCE NO. 367, THE CITY’S NONEXCLUSIVE FRANCHISE TO THE CITY OF TACOMA DEPARTMENT OF PUBLIC UTILITIES, LIGHT DIVISION, CLICK! NETWORK, TO PROVIDE CABLE TELEVISION SERVICES

 

 

            WHEREAS, on January 6, 2003, the City Council passed Ordinance No. 367, which authorized Tacoma Public Utilities, Light Division, Click! Network to construct a cable TV network and offer University Place citizens a choice of cable television services for a ten-year period; and

 

            WHEREAS, Click! Network’s cable franchise expires in February 2013; and

 

            WHEREAS, it would be in the citizens’ best interest to extend Click! Network’s cable TV franchise for a period of two (2) years; and

 

            WHEREAS, in that time, City staff and Click! Network staff will have time to renew a franchise that fits the needs of the City of University Place and its citizens.

 

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE DOES ORDAIN AS FOLLOWS:

 

Section 1.         Extension Granted.  The Franchise Agreement with Click! approved by Ordinance No. 367 on January 6, 2003 is hereby extended for two (2) years from the date of its expiration, to February 28, 2015.

 

            Section 2.         Full force and Effect.  With the exception of the extension of the term set forth in Section 2.3 of the Franchise Agreement with Click!, all other terms, conditions, rights and responsibilities contained in said Agreement remain in full force and effect.

 

Section 3.         Severability.  If any one or more sections, subsections or sentences of this ordinance are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this ordinance and the same shall remain in full force and effect.

 

Section 4.         Effective date.  This Ordinance shall take effect five days after publication.

 

            PASSED BY THE CITY COUNCIL ON APRIL 1, 2013.
