ORDINANCE NO. 629
AN ORDINANCE OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, AMENDING TITLE 19 OF THE UNIVERSITY PLACE MUNICIPAL CODE, ZONING CODE INCLUDING AN AMENDMENT TO THE ZONING MAP 19.20.050 TO INSURE CONSISTENCY WITH COMPREHENSIVE PLAN MAP AMENDMENTS AND TO COMPLY WITH THE REQUIREMENT TO UPDATE THE COMPREHENSIVE PLAN IN ACCORDANCE WITH THE GROWTH MANAGEMENT ACT, RCW 36.70A 130(5)(a)
WHEREAS, the University Place City Council adopted a Comprehensive Plan on July 6,1998 which became effective July 13, 1998 with amendments on May 1, 2000, August 4, 2003; and December 2004 and February 2012; and
WHEREAS, the Revised Code of Washington 36.70A.040 requires the City to adopt development regulations which are consistent with and implement the Comprehensive Plan; and
WHEREAS, the Planning Commission held several public meetings in 2012 including a public hearing on September 5th 2012 to consider area wide Zoning Map Amendments for consistency with proposed Comprehensive Plan Map Amendments; and
WHEREAS, on September 19, 2013 the Planning Commission unanimously recommended amendments to the Zoning Map including one attached hereto as Exhibit A to insure consistency with recommended Comprehensive Plan Map Amendments; and
WHEREAS, the Zoning Map amendment in Exhibit A is consistent with the Growth Management Act, including RCW 36.70A130(5)(a), VISION 2040 and the County Wide Planning Policies, and
WHEREAS, a SEPA Determination of Non-Significance (DNS) and adoption of existing environmental documents was issued on July 26, 2013 for the Zoning Map Amendment with a comment period ending on September 27, 2013, and
WHEREAS, the required State agency 60-day review period on the Zoning Map Amendment began on July 26, 2013 and concluded on September 27, 2013, and
WHEREAS, the City Council held two study sessions and public hearings on October 7 and 21, 2013 to take public comment and discuss proposed Comprehensive Plan amendments, and
WHEREAS, the City Council finds the amendment is consistent with the goals, objectives and policies of the Comprehensive Plan; the proposed amendment is in the best interest of the citizens and property owners of the City; the proposed amendment enhances the public health, safety, comfort, convenience, or general welfare; and the proposed amendment to the zoning map will not be materially detrimental to uses in the vicinity in which the subject property is located.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Title 19 Zoning -- Section 19.20.050 Zoning Map. University Place Municipal Code Section 19.20.050 is hereby amended to change Parcels 6465000019, 6465000018, 6465000026, 6465000027, 6465000037, 6465000051, 6465000055, 6465000056, 6465000060 and 6465000068 from Light Industrial – Business Park to Commercial as shown on Exhibit “A” attached.
Section 2. Copy to be Available. One copy of this Ordinance shall be available in the office of the City Clerk for use and examination by the public.
Section 3. Severability. If any section, sentence, clause, or phrase of this Ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this Ordinance.
Section 4. Publication and Effective Date. A summary of this Ordinance consisting of its title shall be published in the official newspaper of the City. This Ordinance shall take effect five days after publication.
