ORDINANCE NO. 679
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, AMENDING CHAPTERS 13.05, 13.20, 13.25 AND 19.54 OF THE UNIVERSITY PLACE MUNICIPAL CODE
WHEREAS, Title 13 of the University Place Municipal Code (UPMC) has been adopted by the City Council as the Public Works Code which establishes the standards for the construction, improvement and maintenance of transportation and storm drainage facilities, utilities, grading and clearing, emergency vehicle access, and related amenities, whether such activities occur in public rights-of-way or on private lands, and establishes procedures to administer these standards; and
WHEREAS, Section 19.54 of the UPMC pertains to streetscape standards which duplicate provisions in UPMC Title 13; and
WHEREAS, during the administration of the Public Works Code, several revisions to UPMC Title 13 and UPMC 19.54 have been identified that would clarify development requirements, reduce conflicting provisions, and make these provisions consistent with other adopted regulations and requirements; and
WHEREAS, the City Council reviewed the proposed amendments to UPMC Title 13 and Section 19.54 at a public meeting study session on November 21, 2016; and
WHEREAS, comments from this public study session have been addressed and incorporated in to the proposed revisions;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Amendments to Portions of University Place Municipal Code Sections 13.05, 13.20, 13.25, and 19.54. The City of University Place Municipal Code is hereby amended as indicated in Exhibit A attached.
Section 2. Severability. If any section, sentence, clause or phase of these sections shall be held to be invalid or unconstitutional by a court or competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of these sections.
Section 2. Effective Date and Publication. A summary of this Ordinance consisting of its title shall be published in the official newspaper of the City. This Ordinance shall be in effect five (5) days after publication.
