ORDINANCE NO. 700

 

AN ORDINANCE OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, AMENDING UNIVERSITY PLACE MUNICIPAL CODE TITLE 10 RELATING TO TRAFFIC AND SPEED LIMITS

 

 

WHEREAS, the City has conducted an engineering and traffic investigation pursuant to the authority granted by the municipal code and RCW 46.61.415 to evaluate whether UPMC 10.10.030 should be amended by reducing the speed limit on Cirque Drive between Bridgeport Way and Grandview Drive from 35 mph to 30 mph; and

 

WHEREAS, that investigation has reviewed the existing roadway conditions, examined accident data and evaluated speed limit data; and

 

WHEREAS, that investigation noted, in part, that the section of Cirque Drive between Bridgeport Way and 83rd Avenue contains several risk factors including dense turning movements, a high amount of direct driveway access, high pedestrian traffic, the presence of a school, and pedestrian crossings. Vehicle speeds in this segment indicate that most drivers recognize these factors with 85% of the vehicles travelling at 30 mph or less. Streets with similar characteristics are often posted with 30 mph speed limits; and

 

WHEREAS, the appropriate administrative staff has recommended that, in response to the engineering and traffic investigation performed pursuant to WAC 308-330-270 and RCW 46.61.415, the speed limit on Cirque Drive between Bridgeport Way and 83rd Avenue should be changed to 30 mph but maintain the existing speed limit and advisory signage on Cirque Drive between 83rd Avenue and Grandview Drive; and

 

WHEREAS, it was discovered upon review of the current traffic regulations in UPMC Title 10 that the designation of the city traffic engineer needed to be updated to reflect current practices.

 

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, DO ORDAIN AS FOLLOWS:

 

            Section 1.   UPMC 10.10.030 entitled, “Setting maximum speed limits in excess of or less than 25 miles per hour on certain streets,” shall be amended to read as follows:

 

The City Council sets maximum speeds on City streets as follows:

 

A.      Grandview Drive: Cirque Drive West to 27th Street West – 30 miles per hour.

B.      Grandview Drive: 64th Street West to Cirque Drive West – 30 miles per hour.

C.      Bridgeport Way West from the south city limits to Cirque Drive – 35 miles per hour.

D.      Bridgeport Way West from 35th Street West to Cirque Drive West – 30 miles per hour.

E.      Bridgeport Way West from 35th Street West to north city limits – 35 miles per hour.

F.      67th Avenue West from Bridgeport Way to 19th Street West – 35 miles per hour.

G.      Orchard Street West: Hanna Pierce Road to 64th Street West – 40 miles per hour.

H.      27th Street West: Bridgeport Way to Regents Boulevard – 35 miles per hour.

I.       Regents Boulevard: 27th Street West to 67th Avenue West – 35 miles per hour.

J.       40th Street West: Drexler Drive West to 67th Avenue West – 35 miles per hour.

K.      Cirque Drive West: Grandview Drive West to Orchard Street 83rd Avenue– 35 miles per hour.

L.      Cirque Drive West: 83rd Avenue to Bridgeport Way West -- 30 miles per hour.

M.     Cirque Drive West: Bridgeport Way West to Orchard Street -- 35 miles per hour.

LN.    64th Street West: Grandview Drive West to Chambers Creek Road West – 30 miles per hour.

MO.   Chambers Creek Road West: south city limits to 64th Street – 30 miles per hour.

NP.    Chambers Creek Road West: 64th Street West to Chambers Lane West – 30 miles per hour.

OQ.   Chambers Creek Road West: Chambers Creek Lane West to Bridgeport Way West – 30 miles per hour.

PR.    Chambers Creek Road West: Chambers Creek Road West to Bridgeport Way West – 30 miles per hour.

QS.   Grandview Drive from 27th Street West to 19th Street West – 25 miles per hour.

 

Section 2.   UPMC 10.20.010 entitled, “City manager authorized to appoint director as city traffic engineer” is retitled, “City Manager Authorized to Appoint Traffic Engineer,” and shall be amended to read as follows:

           

The city manager is hereby authorized to appoint the community development director as the a city’s traffic engineer with the authority to perform all functions allowed in the Revised Code of Washington and Chapter 308-330 WAC.

 

Section 3.   UPMC 10.20.020 entitled, “Street Closures” shall be amended to read as follows:

           

A.  The city shall contract with a qualified engineer to serve as traffic engineer.  The traffic engineer shall have the authority granted by WAC 308-330-265 and 308-330-270, including any amendments thereto.

           

B.  The city manager upon the advice of the traffic engineer may close any city street to traffic to protect the public safety.

           

C.  The city manager, upon the advice of the city police chief, or such officer authorized to act in that capacity, may close any city street to traffic for purposes of public events or privately sponsored events such as, but not limited to, street fairs.

           

Section 4.   Corrections by City Clerk or Code Reviser. Upon approval of the city attorney, the city clerk or the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state, or federal laws, codes, rules, or regulations; or ordinance numbering and section/subsection numbering.                             

                             

Section 5.   Supplemental Grant of Authority.  The City Council directs the proper officials of the City to take any other and further actions deemed necessary to implement the policies and determinations of the Council consistent with the language of this Ordinance.  Any actions taken consistent with the authority granted by, but before the effective date of this Ordinance, is ratified, approved and confirmed.

                             

Section 6.   Severability. If any portion of this Ordinance or its application to any person or circumstances is held invalid, the remainder of the Ordinance or the application of the provision to other persons or circumstances shall not be affected.

                             

Section 7.   Effective Date. This Ordinance shall be in full force and effect five (5) days after publication of the Ordinance Summary.
