ORDINANCE NO. 741

 

AN ORDINANCE OF THE CITY OF UNIVERSITY PLACE AMENDING TITLE 19 OF THE UNIVERSITY PLACE MUNICIPAL CODE AND AMENDING THE ZONING MAP; IMPLEMENTING A FORM BASED ZONING CODE IN SUPPORT OF THE UNIVERSITY PLACE REGIONAL GROWTH CENTER SUBAREA PLAN

 

 

WHEREAS, in 2014 the Puget Sound Regional Council granted the City of University Place’s Regional Growth Center “Provisional” status with full designation dependent of the adoption of a Subarea Plan; and

 

            WHEREAS, the City of University Place adopted the Regional Growth Center Subarea Plan on November 11, 2017 and received full Regional Growth Center Designation from PSRC on July 26, 2018; and

 

            WHEREAS, following the adoption and designation, the City began implementing the Action Strategy of the Subarea Plan.  The Action Strategy includes amending the Comprehensive Plan and Zoning Code for consistency with the Subarea Plan. The Action Strategy recommended adopting a Form-Based Code for the Regional Growth Center; and

 

            WHEREAS, the City hired a consultant to assist with developing a form-based code.  Several public meetings and an extensive outreach program were employed during code development; and

 

            WHEREAS, the City Council established and appointed the Planning Commission to advise the City Council on the following topics: growth management; general land use and transportation planning; long range capital improvement plans; and other matters as directed by the City Council; and

 

            WHEREAS, the Planning Commission is charged with holding hearings on and developing a Comprehensive Plan for the City and making recommendations to the City Council on amendments to the Comprehensive Plan, the zoning code and map, and other development regulations of the City; and

 

WHEREAS, on December 3, 2018 the City Council adopted Resolution 879, the 2019 Planning Commission Work Plan to work on amendments to the Zoning Code to implement the Subarea Plan including a Form-Based Code; and

 

WHEREAS, in 2019 and 2020 the Planning Commission reviewed and recommended amendments to the Zoning Code for consistency with and to implement the Subarea Plan. Amendments include adding a new Chapter 19.54 “A Form Based Code for the Regional Growth Center”, designating new zones in the Regional Growth Center, and consolidating design standards; and

 

WHEREAS, on August 10, 2020 the City published a Notice of Public Hearing in the Tacoma News Tribune for a Planning Commission public hearing to be held on August 19, 2020; and

 

WHEREAS, on August 19, 2020 the Planning Commission found the proposed amendments are consistent with the goals and policies of the Comprehensive Plan and the Regional Growth Center Subarea Plan, are in the best interest of the City’s citizens and property owners and will enhance the public health, safety, comfort, convenience, and general welfare; and

 

WHEREAS, the Planning Commission considered the approval criteria listed in Section 22.25.030 of the University Place Municipal Code and voted unanimously to recommend to the City Council approval of the proposed Zoning Code Amendments with minor revisions in Planning Commission Resolution 2020-01 supported by written findings and conclusions showing the following:

 

1.              That the proposed amendment is consistent with the goals, objectives, and policies of the comprehensive plan; and

2.   That the proposed amendment is in the best interest of the citizens and property owners of the City; and

 

3.   That the proposed amendment enhances the public health, safety, comfort, convenience, or general welfare; and

 

 

WHEREAS, the City issued a SEPA Determination of Non-significance/ Incorporation by Reference of Environmental Documents/Adoption of Existing Document/Addendum to Existing Environmental Document pertaining to Draft Comprehensive Plan Amendments on October 30, 2020 with a 14-day comment period, and no adverse comments were received; and

 

WHEREAS, the City submitted a Notice of Intent to Adopt to the Washington State Department of Commerce on October 20, 2020 which was issued to state agencies for a 60-day comment period ending December 2, 2020 as required pursuant to Chapter 36A.70 RCW; and

           

WHEREAS, the City Council considered the proposed Zoning Code Amendments at a study session on November 2, 2020 and directed staff to prepare to hold a public hearing before the City Council on the proposed Zoning Code Amendment; and

 

WHEREAS, the City Council conducted a public hearing on the Zoning Code Amendments on December 7, 2020, following notice to the public in accordance with the municipal code and state law, to consider public comment and further revisions recommended by staff in response to agency comments received;

 

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON DO ORDAIN AS FOLLOWS:

 

            Section 1.   The following chapters, or parts of chapters as denoted in the exhibits set forth herein (sections not identified in the exhibits are not amended), of Title 19 UPMC are hereby amended or promulgated as set forth identified by Exhibit and Chapter number as if set forth herein; Chapter titles containing strikethroughs and underlines are retitled accordingly:

            Section 2.   The following chapters of Title 19 UPMC are repealed in their entirety:

 

            Chapter 19.51 UPMC,

            Chapter 19.52 UPMC.

 

            Section 3.  The City of University Place Zoning Map is amended as set forth on Exhibit S attached hereto and adopted by reference.

 

            Section 4.   Corrections by City Clerk or Code Reviser. Upon approval of the city attorney, the city clerk or the code reviser are authorized to make necessary corrections to this ordinance, including the correction of clerical errors; references to other local, state, or federal laws, codes, rules, or regulations; or ordinance numbering and section/subsection numbering.

 

            Section 5.   Severability.  The provisions of this ordinance are declared separate and severable.  The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances.

 

            Section 6.  Savings.  No offense committed, no penalty or forfeiture incurred prior to the effective date of this Ordinance, nor any proceeding undertaken to enforce this Ordinance, nor any actions to safeguard public health, public safety public property or the public peace shall be affected by this Ordinance and the same shall proceed in all respects as if this Ordinance had not been enacted.  Furthermore, any act, claim or action undertaken pursuant to any provision of this Section is not intended to be lost, impaired or affected by this Ordinance.

 

            Section 7.   Effective Date and Publication.  A summary of this ordinance consisting of its title shall be published in the official newspaper of the City.  This ordinance shall be effective five (5) days after passage and publication of an approved summary of this ordinance.
