RESOLUTION NO. 846
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE AUTHORIZING UP FOR ARTS TO DEVELOP AN ART INSTALLATION FOR THE CURRAN APPLE ORCHARD
WHEREAS, UP for Arts is a non-profit, 501C3 community organization formed in 2000 to bring public art to University Place; and
WHEREAS, UP for Arts is a city partner that has worked with the City to solicit, fund and install public art in public places throughout the City to beautify the City and promote the enjoyment of public art; and
WHEREAS, UP for Arts has approached the City about fundraising for the purpose of designing, building and installing an art sculpture for the Curran Apple Orchard, but also desires preliminary approval by the City before beginning fundraising; and
WHEREAS, an art installation in the Curran Apple Orchard would continue to promote and develop art throughout the City to contribute to the sense of place and community pride, expand individual appreciation for art, and attract visitors and prospective businesses;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON:
Section 1. Incorporation of Recitals. The recitals are hereby incorporated herein as if set forth in full.
Section 2. Conditional Acceptance of Donation. Subject to the conditions set forth herein, the City of University Place conditionally accepts the donation by UP for Arts for the installation of a sculpture in the Curran Apple Orchard.
Section 3. City Review and Approvals. Prior to the creation of the sculpture, UP for Arts will present a recommended art installation for City Council review. The City Council may accept or reject the installation in its sole discretion. Should the City Council choose to accept the recommendation, acceptance will be by written resolution of the Council, and may include an accompanying written agreement between the City and UP for Arts setting forth the specific terms and conditions for installation of the art. Approval of the proposed art will not obligate the City to fund any portion of the costs of developing or installing the art.
Section 4. Ownership and Maintenance of the Art. If UP for Arts is successful in fundraising, developing and installing, according to City specifications and permits, the approved art, following receipt of the sculpture by the City, the costs of maintenance, insurance and any liability arising from the artwork will be borne solely by the City.
Section 5. Supplemental Grant of Authority. The City Council directs the proper officials of the City to take any other and further actions deemed necessary to implement the policies and determinations of the Council consistent with the language of this Resolution. Any actions taken consistent with the authority granted by, but before the effective date of this Resolution, is ratified, approved and confirmed.
Section 6. Effective Date. This Resolution shall be effective immediately upon adoption by the City Council.
