RESOLUTION NO. 913
A RESOLUTION OF THE CITY OF UNIVERSITY PLACE, WASHINGTON AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN THE PIERCE COUNTY, WEST PIERCE FIRE DISTRICT AND THE CITY OF UNIVERSITY PLACE
WHEREAS, in 2006, the City of University Place, Pierce County and West Pierce Fire entered into the University Place Communications Facility Fire District #3 Interlocal Agreement Between the City of University Place, Pierce County and Pierce County Fire District # 3 (the “Interlocal Agreement”) for a radio communications facility, consisting of a communications tower, building and associated equipment on land owned by West Pierce; and
WHEREAS, of the other signatories to the Interlocal Agreement has requested an amendment, which the City does not oppose; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, AS FOLLOWS:
Section 1. City Manager Authorized to Execute Agreement. The City Council hereby authorizes the City Manager to execute the Amendment to the Interlocal Agreement between the City of University Place, West Pierce Fire District and Pierce County pertaining to the University Place Communications Facility Fire District #3 Interlocal Agreement Between the City of University Place, Pierce County and Pierce County Fire District # 3 in substantially the form on-file with the City Clerk.
Section 2. Completion of Transaction. The City Manager or designee is authorized to take and execute any additional measures or documents that may be necessary to complete this transaction and to implement the Amendment, which are consistent with the executed Interlocal Agreement and the associated Amendment to the Interlocal Agreement and the terms of this Resolution.
Section 3. Corrections. Upon approval by the City Attorney, the City Manager or designee are authorized to make necessary corrections to the proposed Amendment, including the correction of clerical errors; references to other local, state, or federal laws, codes, rules, or regulations; or numbering and section/subsection numbering, as necessary as may be consistent with the associated Amendment and the terms of this Resolution.
Section 4. Effective Date. This Resolution shall take effect immediately upon its adoption.
