RESOLUTION NO. 921
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE ACCEPTING THE DONATION OF “FOREVER FRIENDS”
WHEREAS, on August 7, 2017, the University Place City Council passed Resolution 846 “authorizing UP for Arts to develop an art installation for the Curran Apple Orchard;” and
WHEREAS, Section 4.40.240(C) of the University Place Municipal Code provides in part that “The city manager or his or her designee is hereby authorized to accept on behalf of the city all monetary donations and gifts to the city.” By contrast, Section 3 of Resolution 846 provides, in part, that subject to certain conditions “The City Council may accept or reject the installation in its sole discretion[,]” with an affirmative decision to accept the donated art, acceptance will be by written resolution of the Council;” and
WHEREAS, it is appropriate to resolve the apparent inconsistency between the Code and Resolution 846; and
WHEREAS, over the last three years, UP for Arts, on its own initiative, has raised the funds necessary to design, cast and construct “Forever Friends,” with the goal that it be donated to the City to enhance the Curran Apple Orchard Park; and
WHEREAS, UP for Arts has donated a statue named “Forever Friends” to the City and “Forever Friends” has now been installed in the Curran Apple Orchard Park; and
WHEREAS, as recognized by UP For Arts, this life-size bronze sculpture of a young girl offering an apple to a horse represents “the deep connection between our rural past and our hope for the future, triggering memories of University Place’s early days while looking forward to the new memories yet to be made;”
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, AS FOLLOWS:
Section 1. Acceptance of Art Work. The City Council of the City of University Place hereby accepts from UP for Arts the donation of “Forever Friends.”
Section 2. Effective Date. This Resolution shall be effective immediately upon adoption by the City Council.
