RESOLUTION NO. 923
A RESOLUTION OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, AUTHORIZING THE CITY MANAGER TO TAKE THE NECESSARY STEPS TO DEDICATE 3,345 SQUARE FEET OF PARK PROPERTY AS PUBLIC RIGHT OF WAY ALONG 67TH AVENUE WEST
WHEREAS, the City of University Place has identified the need for pedestrian and roadway improvements along 67th Avenue West between 40th Street West and Regents Boulevard and has designated the project, 67th Avenue Phase 1, to provide for these improvements; and
WHEREAS, a 5-foot strip of property is needed across the frontage of the Paradise Pond park in order to accommodate these improvements; and
WHEREAS, the City has secured federal grants for the design and right-of-way acquisition for the 67th Avenue Phase 1 project; and
WHEREAS, 23 CFR 774 requires a Section 4(f) De Minimis Impact Determination be conducted for any project that proposes to use park property to accommodate federally funded transportation facilities; and
WHEREAS, the City has performed the Section 4(f) De Minimis Impact Determination and has determined the project will not negatively impact the park; and
WHEREAS, The City’s Director of Public Works, Parks and Facilities has represented, on behalf of the City’s Parks and Recreation Advisory Commission, as it relates to the public right of way, concurs and states that the project and proposed improvements will have a de minimis impact on the park;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PLACE, WASHINGTON, AS FOLLOWS:
Section 1. Incorporation. The recitals are hereby incorporated herein as if set forth in full.
Section 2. The City Manager or his designee is hereby authorized to take the necessary steps to dedicate that certain property, already owned by the City of University Place, across the frontage of Paradise Pond Park as public right of way in order to accommodate the 67th Avenue Phase 1 project.
Section 3. Effective Date. This Resolution shall take effect immediately upon signing.
